Information provided in the case of contracts promoted and placed remotely

Introduction

This notice is provided in order to inform you of the rights and options granted to you under the applicable legislation, due to the contract placement method used by Fit2You Broker S.r.l., hereinafter the “Broker”.

The insurance policy is taken out through a distance selling system.

“Distance selling” means the distribution and conclusion of insurance policies without the simultaneous physical presence of the Intermediary and the Customer, and therefore through the use of internet applications, call centres or other distance communication methods. Once concluded, the contract is then sent to the Customer on a durable medium.

“Durable medium” means any instrument that allows the Customer to store the documentation and related information addressed personally to them, so that it remains accessible and available for consultation for a period of time appropriate to the purposes for which it was sent, and that allows the identical reproduction of the stored information.

1. Procedure for taking out an insurance contract

The procedure will begin with the entry of your personal data and the details of the vehicle you wish to insure, as well as all other information strictly necessary for the Broker to issue a quotation for the policy you wish to purchase.

Once the quotation has been generated, and after you have reviewed the pre-contractual documentation and the information set(s), hereinafter collectively the “Documentation”, you may request that the quotation be sent to the email address provided during data entry, together with all the Documentation. Alternatively, you may choose to continue with the contract completion procedure with the assistance of the intermediary you have contacted.

Following your request, you will receive an email from the Broker containing a link through which you can continue the contract subscription procedure and activate your policy.

You will then be asked to answer a number of questions in order to record your preferences in the “Questionnaire for assessing the consistency of the insurance contract with the policyholder’s needs and requests”. It is important that the data contained in the documents and your statements are correct and correspond to your actual needs. This will allow Fit2You Broker S.r.l. to provide you with a satisfactory service that meets your expectations.

During the policy activation procedure, the pre-contractual documentation will once again be brought to your attention, including the information relating to the insurance intermediary — M.U.P., formerly Annexes 3, 4 and 4-ter — the Broker’s contractual documentation, namely the Brokerage Mandate and Insurance Consulting Agreement, and the documentation required to join the advanced electronic signature service, or FEA. Joining the electronic signature service is a prerequisite for concluding the contract.

Please note: If at any time you encounter difficulties during the procedure, or realise that you have provided and/or confirmed incorrect data, you may contact the following toll-free number: 800-978502. Our contact centre is available Monday to Friday, from 9:00 am to 1:00 pm and from 2:00 pm to 6:00 pm.

Our operators have the experience and professional qualifications required to ensure you receive a high-quality service designed to meet your needs.

Once you have correctly uploaded the required data and/or documentation, you will be able to view the insurance package selected on the basis of your expectations and needs, including the details of the individual cost items that make up the total amount. At the end of the procedure, you will receive a further document by email, again showing the cost items that make up the amount you have paid.

If you wish to proceed with the purchase, you can complete payment by following the guided procedure and entering the required data in the dedicated payment form. In this case too, you may contact our contact centre if you wish to correct the data shown in the documentation.

Fit2You Broker S.r.l. works with leading companies in the electronic payments sector, which guarantee high IT security standards and hold all the certifications and qualifications required by law. Fit2You Broker S.r.l. will not in any way become aware of the data relating to your payment method.

At the end of this procedure, you will receive an email at the address you provided, allowing you to start the digital signing process for the documentation through the FEA — Advanced Electronic Signature — system.

Please note: If you do not receive the electronic envelope containing the document set to be signed, you may call the toll-free number indicated above to request that a new envelope be sent. If the documents are not signed, our operators will contact you.

2. Transmission of documentation

The contract will be provided to you in a format that allows it to be stored on a durable medium, so that you can keep the information and communications addressed to you and retrieve the documentation for an appropriate period of time for the purposes connected with it.

With this document, the Broker also informs you that you may subsequently request, at any time and at no additional cost to you, that the documentation be sent to you in paper format.

This request must be made explicitly by contacting the intermediary directly and may be made jointly or separately for each category of documents provided to you.

You may submit your request by writing to the following addresses:

Email: info@fit2you.it
Certified email: fit2you@legalmail.it

Your preference regarding the delivery of documentation on paper will also apply to subsequent communications sent during the term of the contract.

This request does not affect the validity of communications previously made.

3. Contract language, applicable law and competent court

All contractual and pre-contractual documentation will be drafted in Italian, as will all communications relating to the existing relationship.

Italian law will apply to the insurance contract.

In the event of disputes arising from, or in any case connected with, the contractual relationship between you and/or the Insurance Company, the competent court will be the one indicated in the contractual documentation you have signed. In any case, we invite you to review the information contained in the Complaints section on the Broker’s website, www.fit2you.it.

4. Conclusion and entry into force of the contract

The contract is considered concluded following payment of the premium and will come into force at 12:00 midnight on the day on which payment was made, or from the time and date of effect indicated in the membership form or policy, if different.

5. Right of withdrawal

No later than 14 — fourteen — days from the date of conclusion of the contract, you may withdraw from it by sending a communication by registered letter with return receipt or by certified email, containing the contract identification details, addressed to the Intermediary and to the Insurance Company with which the contract was concluded.

A copy of the signed membership form or policy must be attached to the communication.

The withdrawal will take effect from 12:00 midnight on the day the communication is received.

Following withdrawal, the Customer is entitled to reimbursement of the premium relating to the unused period, net of taxes and the National Health Service contribution.

6. Procedure for requesting a refund

To submit a refund request, please contact our dedicated office by sending written communication by email to the following address: rimborsi@fit2you.it.
